The Court granted bail to the petitioner with conditions of bond, sureties, and mandatory attendance at trial dates.

Summary

Vijay Singh was arrested in connection with a case registered under multiple IPC sections (147, 149, 341, 323, 307, 504, 506) and Section 27 of the Arms Act, alleged to have fired at an informant without hitting anyone. He had been in judicial custody since 29 January 2026 and filed an application for bail, claiming innocence and that he was falsely implicated. The State opposed bail, contending that Singh is a veteran criminal with about twenty prior cases. After hearing both sides, the Patna High Court considered the seriousness of the offences, the petitioner’s custody duration, and his willingness to cooperate. The Court granted bail on the condition of a Rs 10,000 bond, two sureties of equal amount, and a requirement that Singh attend every trial date and mark weekly attendance at Nawada Muffasil.

  • Whether bail should be granted to the accused despite the gravity of the offences and alleged criminal antecedents.

2 07-04-2026 Heard learned counsel for the petitioner, learned counsel

for the informant and the learned APP for the State.

                                 2. The petitioner has prayed for bail in connection with

Nawada Muffasil P.S. Case No. 394 of 2023 registered for the

                   offence punishable under Sections 147, 149, 341, 323, 307, 504,

506 of the Indian Penal Code and Section 27 of the Arms Act.

                                 3. The case of the prosecution, in short, is that the

petitioner has fired at the informant but the fire missed the aim. It

is further alleged that other accused persons have assaulted.

                                 4. Learned counsel appearing on behalf of the petitioner

has submitted that petitioner is innocent and has committed no

offence. He has been falsely implicated in this case. He also

submits that only allegation against the petitioner is that he has

made a fire which did not hit anybody. He further submits that the

petitioner is languishing in judicial custody since 29.01.2026.

                                                       2/2

                                  5. The application for bail is vehemently opposed by the

learned counsel for the informant and the learned APP for the

State. Learned counsel for the informant submits that the petitioner

is a veteran criminal and he is having criminal antecedent of 20

                     cases.

                                  6. Having heard learned counsel for the parties and

considering the facts and circumstances of the case, this Court is

inclined to enlarge the petitioner on bail with the condition that

the petitioner shall cooperate in the trial and shall remain

physically present on each and every date fixed by the learned

trial court and shall mark his weekly attendance at Nawada

Muffasil. The above named petitioner is directed to be enlarged

on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand

only) with two sureties of the like amount each to the satisfaction

of the learned Additional Chief Judicial Magistrate-I, Nawada in

connection with Nawada Muffasil P.S. Case No. 394 of 2023.
