Patna High Court

Ravi KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted anticipatory bail to the petitioner subject to specified conditions.

Summary

The petitioner, Ravi Kumar, sought anticipatory bail fearing arrest in a case under Section 303(2) of the Bharatiya Nagarik Suraksha Sanhita (BNS) concerning a stolen tractor. He was not named in the FIR; his name surfaced only through statements of co‑accused Rahul Kumar and Manish Kumar Yadav, who had already been granted regular bail. The State opposed the anticipatory bail, arguing the petitioner’s implication was material. The Court, considering the lack of direct FIR mention and the bail already granted to co‑accused, granted anticipatory bail subject to a Rs.10,000 bond, two sureties, cooperation with investigation, and verification of any criminal antecedent. The order invoked Section 438(2) of the CrPC and Section 482(2) of the BNS, 2023.

Issues considered

  • Whether anticipatory bail should be granted to a person not named in the FIR but implicated through co‑accused statements under Section 303(2) of the BNS.
