Holding
The court held that the petitioners are entitled to regular bail as there is no material linking them to the seized items and they have no criminal antecedent.
Summary
The petitioners, two students, were arrested in connection with a cyber‑fraud case where police recovered laptops, mobiles, SIM cards and bank instruments from the house of a third‑party, Yamuna Ram. The prosecution alleged their involvement, while the petitioners claimed innocence, stating that nothing was seized from them, they had no criminal antecedent, and they were merely attending a puja at the premises. They sought regular bail under multiple sections of the Bihar Negotiable Instruments Act (BNS) and the Information Technology Act, having been in judicial custody since 9 January 2026. The State opposed bail, but the court, after considering the lack of direct evidence linking the petitioners to the seized items and their clean record, decided to grant bail. Each petitioner was ordered to furnish a bail bond of Rs 10,000 with two sureties, subject to the satisfaction of the Additional Chief Judicial Magistrate‑II, Nawada.
Issues considered
- Whether the petitioners are entitled to regular bail despite the prosecution's allegation of involvement in cyber fraud.
- Whether the seizure of electronic devices and financial instruments from a third‑party's house can be attributed to the petitioners.
