Mahendra SadaiversusThe State of Bihar

Decided

BAIL GRANTED

Holding

The Court allowed the petition for anticipatory bail, granting it with monetary and maintenance conditions.

Summary

Mahendra Sadai applied for anticipatory bail fearing arrest in CR No. 567 of 2017, which alleged offences under IPC sections 147, 148, 149, 323, 498-A, 494, 504, 506/34 for alleged dowry‑related assault and torture. The State and the informant opposed the bail, contending the seriousness of the charges. The petitioner claimed innocence and that he had been falsely implicated. Relying on the Supreme Court’s guidelines in Arnesh Kumar v. State of Bihar, the Court granted anticipatory bail under Section 438(2) of the CrPC and Section 482 of the BNSS, subject to a cash bond and two sureties. The order also imposed a maintenance liability of Rs. 5,000 per month to the informant, with non‑payment leading to cancellation of bail, subject to any pending maintenance proceedings.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner despite the grave nature of the offences alleged under the IPC.
  • Whether the Court can condition anticipatory bail on the payment of maintenance to the informant.
