The Court granted bail to the petitioner with a monetary bond and conditions, despite the prior antecedents and procedural issues.

Summary

Rampravesh Ray applied for bail in a case registered under Section 30(a) of the Bihar Prohibition & Excise Act, where 100 litres of illicit liquor were seized from bushes beside his house. The petitioner argued that the seizure was not from his possession and that the police failed to comply with Section 105 of the BNSS during the seizure, contending that he was framed due to his five prior criminal cases. The State opposed the bail, citing the nature of the offence and the petitioner’s antecedents. After hearing both sides, the Court granted bail, imposing a bond of Rs.10,000 with two sureties and a condition that the petitioner not engage in similar offences. The bail order was directed to be executed before the Special Judge Excise‑1, Saran.

Issues considered

  • Whether bail should be granted when the seized liquor was not in the petitioner’s possession
  • Whether non‑compliance with Section 105 of the BNSS by police affects bail eligibility
  • Impact of the petitioner’s prior criminal antecedents on the bail decision
