The Court granted bail to the petitioner, finding no material participation in the alleged murder.
Summary
The petitioner, Jaiboon Nesh (also known as Murat Bano), mother‑in‑law of a deceased woman, was arrested in connection with a murder case (Sahodra P.S. Case No.47 of 2025) alleged under Sections 302, 201 and 34 of the Indian Penal Code. The prosecution alleged that the deceased’s husband, Sarforoddin Ansari, had killed her and that the petitioner had no role in the crime. The petitioner, represented by Advocate Brij Kishor Mishra, argued that the confessional statement of the husband implicated him as the sole perpetrator and that she was a woman in judicial custody since 21‑12‑2025. The State, through APP Choubey Jawahar, opposed bail. After hearing both sides, the Court found insufficient evidence of the petitioner’s involvement and ordered that she be released on bail upon furnishing a bond of Rs 10,000 with two sureties, subject to the conditions of the Judicial Magistrate‑1st Class, Bettiah. The bail was thus granted.
Issues considered
- Whether the petitioner, alleged mother‑in‑law of the deceased, is entitled to bail in a case punishable under Sections 302, 201 and 34 IPC.
- Whether the confessional statement of the accused husband sufficiently excludes the petitioner’s participation in the murder.
