The court granted bail to the petitioner, directing him to furnish a bond of Rs.10,000 with two sureties.

Summary

The petitioner, Rakesh, a driver, was arrested in connection with the seizure of 225 litres of illicit foreign liquor from a vehicle, charged under Sections 30(a), 32(i)(iii) and 41(i)(ii) of the Bihar Prohibition and Excise (Amendment) Act. He contended that he had no knowledge of the liquor, that none was found in his personal possession, and that the police failed to comply with Section 105 of the BNSS while making the seizure. He also highlighted his clean criminal record and that he had been in judicial custody since 8 February 2026. The State opposed bail, but the court, after considering the facts and the alleged procedural irregularities, decided to grant bail. The petitioner was ordered to furnish a bail bond of Rs.10,000 with two sureties of the same amount to the Exclusive Special Judge (Excise)-II, Kaimur.

Issues considered

  • Whether bail should be granted to a driver accused of possession of illicit liquor when he claims lack of knowledge and procedural lapses in seizure.
  • Whether the alleged non‑compliance with Section 105 of the BNSS by the police warrants bail.
