The petitioner is entitled to bail.

Summary

Ravinder Yadav was arrested in connection with a mob assault that resulted in the death of an informant's husband, charged under multiple sections of the Indian Penal Code and Section 27 of the Arms Act. The prosecution alleged that about 30 persons, including the petitioner, participated in the assault using weapons such as rifles and iron rods. The petitioner’s counsel argued that the charge sheet was omnibus, the petitioner was only a member of the mob, had no specific act attributed to him, and had no prior criminal record, having been in judicial custody since September 4, 2025. The State opposed bail, citing the seriousness of the offences. The High Court, after considering the lack of specific allegation against the petitioner and his clean antecedent, ordered that bail be granted on a bond of Rs. 10,000 with two sureties. The order thus allowed the petitioner’s release pending trial.

Issues considered

  • Whether the petitioner is entitled to bail despite being charged with serious offences including murder under the IPC and Arms Act
  • Whether the general and omnibus nature of the charge sheet and the petitioner’s lack of specific alleged act justify granting bail
