BAIL GRANTED

Holding

The court granted bail to the petitioners subject to a bond of Rs. 10,000 and two sureties.

Summary

The petitioners, Aditya Raj and Murari Kumar, were arrested on 27 January 2026 in connection with an assault case (Bithan P.S. Case No. 09 of 2026) involving multiple offences under the BNS. They applied for bail, claiming innocence and alleging that the accusations were unfounded. The court examined the bail application, noting the seriousness of the charges but also the petitioners' right to liberty pending trial. Justice Sandeep Kumar allowed the bail, directing the petitioners to furnish a bail bond of Rs. 10,000 with two sureties of equal amount. The order was limited to the bail matter and did not express any view on the merits of the underlying criminal case.

Issues considered

  • Whether bail should be granted to the petitioners in respect of the offences under Sections 126(2), 115(2), 117(2), 109, 76, 303(2), 352, 351(2) and 3(5) of the BNS.
