Rajesh KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail is granted to the petitioner on a bond of Rs.10,000 with two sureties, subject to specified conditions.

Summary

Petitioner Rajesh Kumar was arrested on 3 January 2026 for alleged contravention of Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018 after 210 litres of Napali liquor were seized from his motorcycle. He filed a bail petition, arguing that the FIR and seizure list showed non‑compliance with Section 103 of the Bihar Narcotic and Smuggling (BNSS) Act, 2023. The State opposed bail, noting a similar pending case against the petitioner. The Court observed the alleged non‑compliance but nonetheless granted bail on a bond of Rs.10,000 with two sureties, imposing conditions of cooperation, presence in court, non‑tampering with evidence, and verification of criminal antecedents. The bail order also empowered the prosecution to seek cancellation if conditions are breached.

Issues considered

  • Whether bail should be granted to the petitioner despite alleged non‑compliance with Section 103 of BNSS, 2023.
  • Whether the existence of a similar pending case affects the grant of bail.
