Ranjeet Ram @ DimagiversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The petitioners are entitled to regular bail in the present case.

Summary

The petitioners, Ranjeet Ram and Manikant Thakur, were arrested in connection with a violent incident that resulted in the death of a man and charged under Sections 103(1) and 3(5) of the Bharatiya Nyaya Sanhita, 2023 and Section 27 of the Arms Act. The prosecution alleged that the accused participated in a mob assault, using firearms and iron rods, leading to the victim's death. The petitioners contended that they were never named in the FIR, were merely identified later during investigation, have clean antecedents, and have been in custody since 3 November 2025. They also highlighted that co‑accused had already been granted bail in separate proceedings. The Court, after considering the facts, the length of custody, and the lack of direct incriminating evidence, ordered that the petitioners be released on regular bail upon furnishing a bond of Rs. 10,000 with two sureties each. The application for bail was therefore allowed.

Issues considered

  • Whether the petitioners, who were not named in the FIR and are alleged participants in a serious offence, are entitled to regular bail.
  • Whether the grant of bail to co‑accused in related matters influences the bail decision for the petitioners.
  • Whether the period of custody and the petitioners' clean criminal record justify the grant of bail.
