Decided
Disposal
DISMISSED

Holding

The court held that bail could not be granted as there was no fresh ground for review and the trial was proceeding.

Summary

The petitioner, Saurabh Kumar, was arrested in connection with Parsa Police Station Case No. 25 of 2024 for offences under Sections 413 and 414 of the Indian Penal Code and Sections 25(1‑b)a and 26 of the Arms Act. He applied for regular bail for the third time, having been in custody since 24 January 2024 and already facing eighteen other criminal cases. Earlier bail applications were rejected on 28 August 2024 and 1 August 2025. The High Court examined whether any fresh ground existed to merit a review of the earlier refusals. Finding that the trial was progressing and no new circumstances were shown, the Court declined to grant bail. Consequently, the bail application was dismissed.

Issues considered

  • Whether the petitioner is entitled to regular bail for offences under Sections 413, 414 IPC and Sections 25(1‑b)a, 26 Arms Act given the ongoing trial and multiple pending cases.
