DISMISSED

Holding

The application for regular bail was dismissed.

Summary

The petitioner, Manoj Manjhi, applied for regular bail in a murder case (Siwan Muffasil P.S. Case No. 206 of 2025) where he is charged under Sections 103(1), 238(a), 61(2) of the Bihar Narcotic Substances Act, 2023 and Section 27 of the Arms Act. The prosecution alleges that the petitioner participated in the killing of the deceased, citing a confessional statement of co‑accused Satish Kumar and the recovery of the murder weapon. The petitioner has been in custody since 24 September 2025. The Court examined the material evidence and the seriousness of the offences. Concluding that the circumstances did not warrant the grant of regular bail, the Court dismissed the bail application, while expressly stating that its observations are confined to the bail matter and do not prejudice the trial.

Issues considered

  • Whether regular bail can be granted to the petitioner accused of murder under the Bihar Narcotic Substances Act, 2023 and the Arms Act, considering the confessional statement of a co‑accused and the recovery of the murder weapon.
