Patna High Court

Rambabu RamversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court allowed the bail application, directing the petitioner to be released on bail upon furnishing a bail bond of Rs.10,000 with two sureties.

Summary

The petitioner, Rambabu Ram, applied for regular bail in a case registered under Sections 103(1), 238 read with Section 3(5) of the B.N.S., alleging dowry‑related torture and the death of his wife, the informant’s daughter. The prosecution alleged that the petitioner and co‑accused tortured the daughter to demand dowry and that she died following abdominal pain, with the body allegedly disposed of. The petitioner contended that the marriage was a love marriage, no dowry was demanded, no prior complaint existed, the death was not unnatural, and no charge‑sheet had been filed under Section 80 of the B.N.S. He also highlighted his lack of criminal antecedents and the welfare of three minor children. The State and the informant opposed bail, maintaining the seriousness of the allegations. After considering the facts, the court directed that the petitioner be released on bail upon furnishing a bail‑bond of Rs.10,000 with two sureties, and allowed the application.

Issues considered

  • Whether regular bail can be granted to the petitioner accused under Sections 103(1), 238 and 3(5) of the B.N.S. for alleged dowry harassment and death
  • Whether the allegations constitute a non‑bailable offence warranting denial of bail
  • Whether the absence of a charge‑sheet under Section 80 of the B.N.S. affects the bail decision

the petitioner and his daughter and after the death of his
