Decided
Disposal
BAIL GRANTED

Holding

The court allowed the bail application and ordered the petitioner’s release on bail.

Summary

The petitioner, Biresh Ram, was arrested in connection with a case registered under Sections 126(2), 115(2), 109, 351(2) and 3(5) of the BNS for allegedly assaulting the victim. He had been in custody since 15 November 2025 and claimed innocence, alleging that the case was fabricated due to a land dispute with the informant, who is an agnate. The petitioner applied for bail, and counsel argued that the allegations were false and that there was no risk of flight or tampering. The court examined the bail application, noting that the observations were limited to bail and not the merits of the case. It granted bail on a bond of Rs. 10,000 with two sureties, directing release pending trial.

Issues considered

  • Whether the petitioner is entitled to bail in a case involving offences under Sections 126(2), 115(2), 109, 351(2) and 3(5) of the BNS.
