Patna High Court

Shrawan Kumar RishiversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court held that anticipatory bail may be granted as the petitioner has no criminal antecedent, no possession of the seized liquor, and the precedent allows bail despite Section 76(2) where no offence is made out.

Summary

Shrawan Kumar Rishi sought anticipatory bail after being implicated in a case under sections 30(a), 41 and 47 of the Bihar Prohibition and Excise Act for the alleged seizure of 4.8 litres of foreign liquor from a motorcycle. He contended that the motorcycle had been sold earlier, he had no possession of the liquor and possessed no criminal antecedent. Relying on the Full Bench decision in Ram Vinay Yadav v. State of Bihar, he argued that anticipatory bail could be granted despite the bar in Section 76(2) if no offence is made out. The State opposed, asserting ownership of the motorcycle. The Court, noting the petitioner’s clean record and the cited precedent, granted anticipatory bail subject to stringent conditions, reserving the right to cancel the bail if any adverse facts emerged.

Issues considered

  • Whether anticipatory bail can be granted under the Bihar Prohibition and Excise Act despite the bar in Section 76(2).
  • Whether the facts alleged in the FIR constitute an offence under sections 30(a), 41 and 47 of the Act.
  • Whether the petitioner’s lack of possession and clean antecedent justify the grant of anticipatory bail.

Subjects

  • anticipatory bail
  • Bihar Prohibition and Excise Act
  • seizure of liquor
  • criminal antecedent
  • Section 76(2)
  • bail conditions

2 16-04-2026 Heard Mr. Arvind Kumar Pandey, learned counsel for

the petitioner and Mr. Shyam Bihari Singh, learned APP for the

                   State.

                                2. The petitioner is apprehending his arrest in

connection with Baisi P.S. Case No. 13 of 2025 for the offence

under sections 30(a), 41 and 47 of the Bihar Prohibition and

Excise Act lodged on 13.01.2025 by the informant, Permanand

                   Paswan.

                                3. As per the prosecution story, the Police, on

information, intercepted a motorcycle and there is

recovery/seizure of 4.800 liters of foreign liquor. This led to the

                   FIR.

                                4. Learned counsel for the petitioner submits that he

has no criminal antecedent, the motorcycle was earlier owned

by him but later sold to Rakesh Kumar Yadav and nothing has

been recovered from his conscious possession.

                       5. Further, learned counsel for the petitioner relied on

the judgment of the Full Bench of Hon’ble Patna High Court in

the case of Ram Vinay Yadav vs. State of Bihar reported in

2019 (2) PLJR 1089 wherein it has been held that an

application for anticipatory bail in a case arising out of Bihar

Excise and Prohibition Act can be maintained, despite the bar

under Section 76(2) of the Act, if on the basis of allegation

made in the FIR, no offence under the said provision is made

          out.

                       6. Learned APP opposes the prayer submitting that he

          owns the motorcycle.

                       7. Taking into account the submissions of the parties

and the judgment in the case of Ram Vinay Yadav (supra), as

also that he has no criminal antecedent, in that background, this

Court is inclined to extend him the privilege of anticipatory bail

          with conditions.

                       8. If, however, it is found that contrary to the

statement made in paragraph-3, the petitioner has criminal

antecedent, the present order shall become infructuous.

                       9. Let the petitioner be released on bail in the event of

(iii) the petitioner shall appear on each and every date
