Patna High Court

Taruni Yadav @ Tarun KumarversusThe State of Bihar

Decided
Disposal
BAIL REJECTED

Holding

The anticipatory bail application was denied as the petitioner’s criminal antecedent and the basis of the allegations did not merit relief.

Summary

The petitioner, Taruni Yadav, sought anticipatory bail fearing arrest in a case (PS Case No.125/25) filed under IPC sections 309(4) and 351(2) based on an FIR lodged on 7 June 2025. The prosecution alleged that the petitioner, along with others, had intercepted an informant en route to a marriage venue, seizing his mobile phone and cash. The petitioner contended he had no involvement and that his name appeared only in a co‑accused’s confessional statement. The State opposed the bail, highlighting the petitioner’s criminal antecedent and the reliance on the co‑accused’s confession. The court, after considering the submissions and the petitioner’s criminal record, concluded that no relief could be granted and rejected the anticipatory bail application.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail under CrPC in view of the allegations under IPC sections 309(4) and 351(2)
  • Whether the petitioner’s criminal antecedent and the reliance on a co‑accused’s confessional statement preclude grant of bail
