Ashok DasversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner subject to specified conditions.

Summary

Ashok Das was arrested in connection with NDPS Case No. 147 of 2025 for alleged possession of 12.01 grams of smack, violating Sections 8(c) and 21(b) of the Narcotic Drugs and Psychotropic Substances Act. The petitioner, claiming a clean antecedent, applied for bail and offered to donate Rs. 25,000 to a charitable organization without admitting guilt. The State opposed the bail, but the Court considered the facts, the petitioner’s background, and the submissions of counsel. The Court granted bail on the condition of a Rs. 10,000 bond with two sureties, a Rs. 25,000 donation to Ramakrishna Math, regular attendance at Harishchandrapur Police Station every Sunday, and verification of the petitioner’s antecedent. The order was limited to the bail application and did not prejudice the merits of the trial.

Issues considered

  • Whether bail should be granted in an NDPS case involving possession of a small quantity of narcotics under Sections 8(c) and 21(b) of the NDPS Act
