Decided
Disposal
BAIL GRANTED

Holding

Bail is granted to the petitioner subject to specified conditions.

Summary

The petitioner, Ranjeet Yadav, was arrested in connection with the seizure of 80.64 litres of illicit liquor and charged under Sections 274, 275 and 317(5) of the Bihar Narcotic Substances Act and Section 30(a) of the Bihar Prohibition and Excise Act. He had been in custody since 26 February 2026 and claimed to have a clean antecedent. The petitioner offered to donate Rs.25,000 to a charitable organization without admitting guilt. The High Court considered the facts, the petitioner’s clean record, and the charitable offer, and ordered his release on bail subject to a bond of Rs.10,000 with two sureties, a deposit of Rs.25,000 to Ramakrishna Math, verification of his antecedent, and monthly police‑station attendance. The order expressly limited its effect to the bail application and did not prejudice the merits of the trial.

Issues considered

  • Whether bail should be granted to the accused in a case of illicit liquor under the Bihar Narcotic Substances Act and the Bihar Prohibition and Excise Act
