Patna High Court

Kaju Yadav @ Kaju Kumar YadavversusThe State of Bihar

Decided
Disposal
DISMISSED

Holding

The Court declined to grant regular bail to the petitioner.

Summary

Kaju Yadav applied for regular bail in a case registered under multiple sections of the BNS and Section 27 of the Arms Act, alleging extortion of Rs. 50,000. The prosecution alleged that he was involved in rangdari (extortion) and highlighted his custody since 21‑Nov‑2025 and involvement in 31 other cases. The petitioner’s counsel sought bail, arguing his right to liberty, while the State opposed on grounds of serious charges and criminal antecedent. The Court examined the nature of the offences, the petitioner’s prior criminal record, and the risk of tampering with evidence. Concluding that the seriousness of the charges and the petitioner’s antecedents outweighed the bail considerations, the Court refused bail. The order was limited to the bail application and did not prejudice the merits of the trial.

Issues considered

  • Whether the petitioner is entitled to regular bail despite multiple serious charges and a history of criminal antecedents.
