Soni DeviversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail is granted to the petitioner with specified conditions.

Summary

Soni Devi was arrested in connection with the seizure of 138.475 litres of illicit liquor from a tempo and has been in custody since 14 February 2026. She applied for regular bail under section 30(a) of the Bihar Prohibition and Excise Act, offering to donate Rs.25,000 to a charitable organization without admitting guilt. The State opposed the bail. The High Court, after considering the facts and the petitioner’s submission, granted bail on a bond of Rs.10,000 with two sureties of the same amount, conditioned on the deposit of Rs.25,000 in Ramakrishna Math and production of the receipt, and on the petitioner’s attendance at Barun Police Station on the first and third Sundays of each month. The order is limited to the bail application and does not prejudice the merits of the trial. The bail bonds will be cancelled upon any default in appearance.
