Patna High Court

Md EjajversusThe State of Bihar

Decided
Disposal
BAIL REJECTED

Holding

Anticipatory bail was denied to the petitioners.

Summary

The petitioners, Md. Ejaj and his father Md. Imteyaz, were named in FIR No. 381 of 2025 for alleged offences under Sections 303(2), 317(5), 318(4) and 3(5) of the Bharatiya Nyaya Sanhita, 2023, relating to a police raid in which a stolen motorcycle with false number plates was discovered. They sought anticipatory bail, claiming innocence and alleging that they were falsely implicated solely because of their relationship to co‑accused Shahnawaz Qadri. The State opposed the bail, emphasizing the seriousness of the charges and the petitioners’ alleged involvement. The Patna High Court, after hearing both sides, declined to grant anticipatory bail, noting the present facts and circumstances. However, the Court directed that if the petitioners surrender within four weeks, the trial court should consider their surrender‑cum‑bail application on the merits without prejudice to the rejection of anticipatory bail.

Issues considered

  • Whether anticipatory bail should be granted to the petitioners under the Bharatiya Nyaya Sanhita, 2023 in view of the alleged offences and their relationship to a co‑accused
  • Whether the petitioners’ prior criminal antecedent (in the case of Md. Ejaj) affects the grant of anticipatory bail
