Mukesh KumarversusThe State of Bihar

Decided

BAIL GRANTED

Holding

The court granted regular bail to the petitioner, subject to a bail bond and verification of a clean antecedent.

Summary

Mukesh Kumar was arrested in connection with a Bihta police case for alleged possession of 25.6 grams of smack, alleged offences under Sections 8(c), 21(b) and 22(b) of the NDPS Act. The petitioner claimed innocence, asserted a clean antecedent and had been in custody since 14 January 2026. The State opposed the bail application. The High Court, after considering the facts and the period of custody, allowed regular bail, directing the petitioner to furnish a bail bond of Rs.10,000 with two sureties, subject to verification of his clean antecedent by the lower court. The order was made prima facie and without prejudice to the merits of the trial.

Issues considered

  • Whether the petitioner is entitled to regular bail under the NDPS Act for alleged possession of 25.6 grams of narcotic.
  • Whether the condition of a clean antecedent must be verified before bail bonds are accepted.
