DISMISSED

Holding

The court denied regular bail to the petitioner.

Summary

The petitioner, Rakesh Kumar, applied for regular bail in a case where 11.2 kg of ganja was recovered from him and an additional 12.5 kg from co‑accused, under Sections 8, 20(b)(ii)(c) and 29 of the NDPS Act. The petitioner claimed innocence and had been in custody since 30 September 2025. The Union of India, represented by the ASG, opposed the bail, emphasizing the large quantity of narcotics seized. The Patna High Court, after hearing both sides, declined to grant regular bail, noting the seriousness of the offence and the substantial drug recovery. The court clarified that its observations were prima facie and limited to the bail application, not affecting the merits of the trial.

Issues considered

  • Whether regular bail should be granted to the accused under Sections 8, 20(b)(ii)(c) and 29 of the NDPS Act in view of the large quantity of ganja recovered.
