Holding

The Court dismissed the second regular bail application, upholding its earlier order denying bail.

Summary

Tanweer Mansoori, accused of offences under Sections 302, 201 and 120(B) of the Indian Penal Code, filed a second application for regular bail before the Patna High Court. His earlier bail plea had been rejected on 3 April 2024. Counsel for the petitioner argued that the trial was advancing, with seven of nine witnesses already examined and no further witnesses appearing, warranting the grant of bail. The Court examined the submission and found no justification to revisit its prior order denying bail. Accordingly, the bail application was dismissed and the Court directed the Superintendent of Police, Araria, to ensure the attendance of the remaining witnesses.

Issues considered

  • Whether regular bail can be granted to the accused at this stage of the trial
