Holding

The Court held that bail could not be granted in view of the large quantity of narcotic drugs recovered.

Summary

The petitioner, Vicky Kumar Sahani, applied for regular bail in a case registered under the Narcotic Drugs and Psychotropic Substances (NDPS) Act for the alleged possession of 5.6 kg of ganja. The prosecution alleged that the seized quantity was large and the offences fell under Sections 8, 20(B)(II)(B), 25, 29 and 23(B) of the NDPS Act. The petitioner’s counsel argued that he was falsely implicated, had no prior criminal record and was willing to cooperate with the trial. The State’s Additional Public Prosecutor opposed bail, emphasizing the seriousness of the offence and the substantial quantity of drugs recovered. Considering the magnitude of the seizure, the Court was not inclined to grant bail and dismissed the bail application.
