Patna High Court

Vishal KumarversusThe State of Bihar

Decided
Disposal
DISMISSED

Holding

The Court denied bail, holding that the gravity of the offences precludes regular bail.

Summary

Vishal Kumar was arrested in connection with a 2019 case involving extortion, murder and disposal of a body, alleged under IPC sections 341, 323, 387, 504, 364 and 34. The petitioner claimed he was falsely implicated, had no prior criminal record and had been in custody since 17‑12‑2025, seeking regular bail. The State opposed bail, arguing his name surfaced during investigation and highlighting the seriousness of the offences. The Court considered the gravity of the charges and the investigation’s findings. Concluding that the seriousness warranted continued detention, the Court dismissed the bail application.

Issues considered

  • Whether bail should be granted to the petitioner given the seriousness of the offences under the IPC.
  • Whether the petitioner’s alleged false implication and lack of criminal antecedent justify bail.

                                     5. Learned APP for the State has opposed the prayer

for regular bail of the petitioner on the ground that the name of

the petitioner has come during investigation.

                                     6. Considering the gravity of the offence, this Court is
