Patna High Court

Ankush SinghversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner.

Summary

Ankush Singh was arrested in connection with a case registered under sections 126(2), 109, 3(5) of the Bihar Negotiable Substances Act and section 27 of the Arms Act, alleged to have fired upon the prosecution side. The petitioner contended that the victim’s injuries were caused by hard blunt objects and that there was a counter‑case, also claiming he himself sustained injuries. He applied for bail, having been in custody since 10 November 2025. The learned senior counsel argued that the allegations did not establish a strong prima facie case justifying denial of bail. Justice Sandeep Kumar considered the material and allowed the bail application, directing the petitioner to furnish a bail bond of Rs 10,000 with two sureties. The order was limited to the bail question and did not prejudice the merits of the trial.

Issues considered

  • Whether the petitioner is entitled to bail despite the serious nature of the offences alleged under the Bihar Negotiable Substances Act and the Arms Act
  • Whether the facts disclosed, including the claim of counter‑case and injuries to the petitioner, justify the grant of bail
