Holding
The Court granted anticipatory bail to the petitioner, subject to a bail bond and verification of his criminal antecedent.
Summary
The petitioner, Shaukat, was implicated in a case involving the alleged recovery of 35.250 litres of foreign liquor, alleged to be a violation of Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022. He contended that he was not present at the scene, had no conscious possession of the liquor, and possessed a clean criminal record. The State opposed any bail, arguing that the offence was serious. The Court examined the petition for anticipatory bail, noting the petitioner’s clean antecedent and the lack of direct evidence linking him to the seized liquor. Relying on Section 2(1)(d) and Section 482(2) of the BNSS, 2023, the Court ordered that the petitioner be released on anticipatory bail if arrested within four weeks, subject to a bail bond of Rs 30,000 and verification of his criminal antecedent. The order also stipulated that any concealment of antecedent would lead to cancellation of the bail.
Issues considered
- Whether the petitioner is entitled to anticipatory bail in view of the alleged offence under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022
- Whether the petitioner’s clean criminal antecedent and lack of conscious possession justify the grant of bail
