Bail was granted to the petitioner subject to monetary, surety, and attendance conditions.
Summary
The petitioner, Sujit Kushwaha, was arrested in connection with the seizure of 126 litres of illicit liquor and charged under Section 317(5) of the Bihar Narcotic Substances Act and Section 30(a) of the Bihar Prohibition and Excise Act, 2022. He had been in custody since 14 January 2026 and claimed innocence, offering to donate Rs. 25,000 to a charitable organization without admitting guilt. The State opposed his bail application. The Court, after considering the circumstances and the petitioner's willingness to provide a financial deposit and sureties, granted bail on the condition of a Rs. 10,000 bond with two sureties, a Rs. 25,000 donation to Ramakrishna Mission Ashram, and mandatory monthly police station attendance. The order is limited to the bail application and does not prejudice the merits of the trial. The bail bonds will be accepted upon verification of the donation receipt.
