Patna High Court

Nitish Kumar @ RajaversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court ordered the release of the petitioner on bail upon furnishing the prescribed bond and sureties.

Summary

The petitioner, Nitish Kumar, was arrested in connection with a case of alleged assault with an iron rod, charged under multiple sections of the Bharatiya Nyaya Sanhita, 2023. He contended that the injury to the informant was minor, that he was falsely implicated, and that he has no prior criminal record, noting that a charge‑sheet had already been filed. The State opposed his bail application. After hearing both sides, the court considered the nature of the alleged offence, the petitioner’s custody since 22‑Oct‑2025, and his lack of antecedents. The court granted bail, directing the petitioner to furnish a bail bond of Rs. 10,000 with two sureties of equal amount, subject to the satisfaction of the Chief Judicial Magistrate, Chapra. The order was pronounced by Justice Khatim Reza.
