Holding

The application for regular bail was dismissed, as the court found the offences grave and saw no ground to overturn its earlier order.

Summary

The petitioner, Raunak Kumar, applied for regular bail in a criminal case (Bakhtiyarpur P.S. Case No. 36 of 2025) involving offences under Sections 109, 61(2), 3(5) of the Bihar Negotiable Instruments Act and Sections 25(1‑B)A and 26 of the Arms Act. An earlier bail application had been rejected on 27‑08‑2025. The petitioner’s counsel argued that the case had not been committed. The High Court examined the gravity of the alleged offences and found no merit to revisit its earlier order. Consequently, the court dismissed the bail application and directed the Principal District Judge to ensure that the case is recorded as committed and that charges be framed in the trial.

Issues considered

  • Whether regular bail should be granted in view of the gravity of the offences alleged against the petitioner.
  • Whether the case can be deemed not committed for the purpose of granting bail.
