Patna High Court

Sunil RaiversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner subject to specified monetary and attendance conditions.

Summary

The petitioner, Sunil Rai, a driver, was arrested on 13 January 2026 in connection with the seizure of 4,752 litres of illicit liquor under Section 30(a) of the Bihar Prohibition and Excise Act. He claimed to have no knowledge of the contraband and a clean antecedent, offering to donate Rs. 25,000 to a charitable organization. The State opposed bail, but the court, after considering the custody period, the petitioner’s role as merely a driver, and his willingness to comply with conditions, granted regular bail. The bail was conditioned on a Rs. 10,000 bond with two sureties, a Rs. 25,000 donation to Ramakrishna Mission Sevashrama, monthly attendance at the police station, and verification of his antecedents. The court also directed the police to arrest the alleged main accused, Chandan Singh, the consignment owner.

Issues considered

  • Whether the driver, alleged to have transported illicit liquor, is entitled to regular bail under Section 30(a) of the Bihar Prohibition and Excise Act.
  • Whether the conditions imposed by the court are appropriate and sufficient to ensure the petitioner’s compliance and the interests of justice.

Subjects
