Patna High Court

Ashish Kumar @ Aashis KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail is granted to the petitioner subject to the conditions imposed by the court.

Summary

The petitioner, Ashish Kumar, was arrested in Nawada district for possession of 700 litres of illicit Mahua liquor, alleged to violate Sections 30(a) and 41 of the Bihar Prohibition and Excise Act. He applied for regular bail, asserting a clean antecedent and offering to donate Rs 25,000 to a charitable organization without admitting guilt. The State opposed the bail. The High Court, after considering the submissions, granted bail on the condition that the petitioner furnish a bail bond of Rs 10,000 with two sureties, deposit the Rs 25,000 donation with Ramakrishna Math and produce a receipt, attend the police station on the 1st and 3rd Sundays of each month, and have his antecedents verified. The court clarified that its observations were prima facie and would not affect the trial. The bail was thus ordered subject to the stipulated conditions.

Issues considered

  • Whether regular bail can be granted to the accused in a case under Sections 30(a) and 41 of the Bihar Prohibition and Excise Act.
  • Whether the conditions imposed by the court, including a charitable donation and periodic police‑station attendance, are lawful and appropriate for bail.

Subjects

  • bail
  • Bihar Prohibition and Excise Act
  • Section 30(a)
  • Section 41
  • Mahua liquor
  • charitable donation
  • court conditions
