Kundan KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court held that bail could be granted in the present case, subject to the execution of a bail bond and sureties.

Summary

The petitioner, Kundan Kumar, was arrested in connection with a case registered under Sections 25(1‑B)a, 26, 27 and 35 of the Arms Act, where a live cartridge was allegedly recovered from him. He applied for regular bail, claiming innocence, a clean antecedent, and that he had been in custody since 19‑09‑2025. The prosecution opposed the bail, arguing the seriousness of the offences under the Arms Act. The Court examined the facts, including the nature of the alleged offence and the petitioner’s personal circumstances. Considering the circumstances, the Court allowed the bail application, directing the petitioner to furnish a bail bond of Rs.10,000 with two sureties of equal amount. The order was pronounced by Justice Sandeep Kumar of the Patna High Court.
