Patna High Court

Jaynath MukhiyaversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted regular bail to the petitioners.

Summary

The petitioners, Jaynath Mukhiya and Sonu Das, laborers from Madhubani, were arrested on 20 February 2026 for allegedly carrying 351 litres of illicit liquor, leading to charges under Sections 274, 275 and 3(5) of the Bharatiya Nyaya Sanhita, 2023 and Section 30(a) of the Bihar Prohibition & Excise Act. They applied for regular bail, arguing they had no role in the crime and had been in custody for a short period. The State opposed the bail application. The Court, after considering the facts, the nature of the offence, and the period of custody, allowed the bail application. Each petitioner was ordered to furnish a bail bond of Rs. 10,000 with two sureties of the same amount, subject to the satisfaction of the trial court. The Court clarified that its observations were prima facie and not to influence the merits of the trial.

Issues considered

  • Whether regular bail should be granted to the accused under Sections 274, 275 and 3(5) of the Bharatiya Nyaya Sanhita, 2023 and Section 30(a) of the Bihar Prohibition & Excise Act given the facts.
  • Whether the period of custody and the alleged role of the petitioners justify the grant of bail.
