Decided
Disposal
DISMISSED

Holding

The Court held that bail could not be granted because the offence was grave and the petitioner was alleged to be part of the conspiracy.

Summary

The petitioner, Kuldeep Uraon, was arrested in connection with a case registered under Section 309(4) of the B.N.S. for allegedly participating in a conspiracy to loot Rs. 75,050 from a finance company. He applied for regular bail, claiming false implication, lack of prior criminal record, and willingness to cooperate with the trial. The State, represented by the Additional Public Prosecutor, opposed bail on the ground that the petitioner was part of the conspiracy. The Court examined the seriousness of the alleged offence and the prosecution’s evidence of involvement. Considering the gravity of the crime, the Court declined to grant bail. The bail application was dismissed, and the Superintendent of Police was directed to ensure the petitioner’s attendance at his scheduled B.A. examinations.
