Holding

The court allowed the application for regular bail, directing the petitioner’s release on bail with conditions.

Summary

Sonu Kumar was arrested in connection with a murder case (Maner P.S. Case No.68 of 2025) and charged under sections 103(1), 303(2), 61(2), 3(5) of the B.N.S. and section 27 of the Arms Act. The informant alleged that Kumar and others killed the informant's brother, whose body was recovered. Kumar had been in custody since 27‑01‑2025 and had no prior criminal record. His earlier bail application was rejected, but he filed a second regular bail petition, claiming false implication and that the trial had not yet commenced. The court, noting the long period of detention and the delay in trial, granted regular bail on a bond of Rs.10,000 with two sureties, subject to the condition that Kumar cooperate with the trial proceedings.

Issues considered

  • Whether the petitioner is entitled to regular bail despite serious charges under the B.N.S. and Arms Act.
  • Whether the length of pre‑trial detention and delay in trial justify granting bail.
  • Whether the petitioner’s lack of criminal antecedents and claim of false implication affect the bail decision.
