The Court dismissed the second bail application, finding no ground to review its earlier order denying bail.
Summary
Ansar, the petitioner, was charged under Section 21(C) of the Narcotic Drugs and Psychotropic Substances (NDPS) Act for the alleged recovery of 560 litres of Wiscodin syrup. He applied for regular bail for the first time, which was rejected on 15 September 2025. On 8 May 2026, he made a second bail application, arguing that the trial was still ongoing and only three of twelve witnesses had been examined. The prosecution contended that the seriousness of the offence warranted continued detention. The Court examined the progress of the trial and found no sufficient ground to revisit its earlier order denying bail. Consequently, the application was dismissed, with liberty to re‑apply if the trial does not conclude within one year.
Issues considered
- Whether regular bail can be granted to an accused under Section 21(C) of the NDPS Act when the trial is still in progress.
- Whether the earlier order denying bail can be reviewed on the basis of the trial’s status.
