Patna High Court

Laddu Singh @ Prince Kumar SinghversusThe State of Bihar

Decided
Disposal
REJECTED

Holding

The Court held that bail could not be granted to the petitioner.

Summary

The petitioner, Laddu Singh, was arrested on 9 June 2025 in connection with a case involving the alleged murder of an informant’s son and related offences under the Bharatiya Nyay Sanhita, 2023 and the Income‑Tax Act. The prosecution’s case rests on a confessional statement of co‑accused Shambhu Kumar, who alleged that Singh participated in the killing and disposal of the body in the Ganga. The petitioner contended that he was never named in the FIR and was falsely implicated based solely on the co‑accused’s confession. The State highlighted Singh’s eight prior criminal antecedents and argued that the confession established his involvement. After considering the seriousness of the charges, the confession, and the petitioner’s criminal history, the Court declined to grant bail. Consequently, the petition for bail was dismissed.

Issues considered

  • Whether the petitioner is entitled to bail despite the co‑accused’s confession implicating him
  • Whether the petitioner’s prior criminal antecedents justify denial of bail

name transpired during investigation on the basis of confessional

statement of co-accused, namely, Shambhu Kumar and the

petitioner is rotting in judicial custody since 09.06.2025.

                                   5. Learned A.P.P. for the State has vehemently

opposed the prayer for bail of the petitioner and submits that the

said Shambhu Kumar has confessed his guilt which was recorded

in paragraph no.47 of case diary in which he had categorically

stated that he along with the petitioner and other co-accused

persons killed informant’s son and thereafter thrown the body of

the deceased in river Ganga near Jamuniya and apart from that

petitioner had also confessed his guilt in the present occurrence.

He further submits that petitioner carries eight criminal

antecedents other than the present one in which he is on bail in all

                  cases.

                                   6. Considering the facts and circumstances of the

case, I am not inclined to enlarge the petitioner on bail in

connection with Jagdishpur P.S. Case No. 73 of 2025, pending in

the Court of Additional Sessions Judge-VII, Bhojpur, Ara.
