Patna High Court

Nitish Kumar @ Nitesh KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail is granted to the petitioner with a bond of Rs.10,000 and specified conditions.

Summary

The petitioner, Nitish Kumar, was arrested on 16 February 2026 in connection with a case involving the alleged possession of 130 litres of country-made liquor recovered from a motorcycle, under Section 30(a) of the Bihar Prohibition and Excise Act. The petitioner claimed he had no conscious possession of the liquor, was not the owner of the motorcycle, and had a clean criminal record. Counsel highlighted that the FIR failed to comply with Sections 103 and 105 of the Bihar Narcotic Substances (BNSS) Act, 2023. The State opposed bail, but the Court considered the lack of direct possession, the procedural lapses, and the petitioner's clean antecedent. Consequently, the Court granted bail on a bond of Rs.10,000 with two sureties and imposed conditions regarding trial cooperation, non‑tampering with evidence, and verification of antecedents.

Issues considered

  • Whether bail should be granted to the petitioner despite the seizure of 130 litres of liquor under the Bihar Prohibition and Excise Act.
  • Whether the non‑compliance of Sections 103 and 105 of the BNSS, 2023, in the FIR warrants bail.
  • Whether the petitioner’s lack of conscious possession and clean antecedent justify bail.
