Patna High Court

Ranjit KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that bail should be granted to the petitioner, subject to specified conditions.

Summary

Petitioner Ranjit Kumar was arrested on 3 January 2026 in connection with a theft case involving a stolen motorcycle, charged under sections 317(5), 318(4), 336(3), 338 and 3(5) of the B.N.S. He claimed innocence, stating the bike was purchased from another person and that he had no knowledge it was stolen. The State opposed bail, arguing that the stolen article had been recovered from the petitioner and that he had another pending case, though he was already on bail in that matter. The court examined the facts, the seriousness of the offences, and the petitioner’s claim of innocence, and decided to grant bail. Bail was ordered on a bond of Rs. 10,000 with two sureties, subject to conditions of cooperation, physical presence, non‑tampering with evidence or witnesses, and verification of criminal antecedents. The order directed that the bail bond not be delayed for verification purposes.

Issues considered

  • Whether the petitioner is entitled to bail despite the recovery of the stolen motorcycle from his possession.
  • Whether the existence of another pending case, in which the petitioner is already on bail, affects the grant of bail in the present case.
  • Whether the court may impose conditions such as cooperation, presence, and verification of antecedents while granting bail.
