Holding
The Court granted bail to the petitioner subject to specified conditions.
Summary
Arjun Yadav was arrested on 20‑12‑2025 in connection with a dowry‑death case (PS case No. 369 of 2025) under Sections 80 and 3(5) of the BNS, 2023. The petitioner claimed a clean antecedent and argued that the FIR was fabricated, noting that the informant herself stated the deceased had committed suicide and no specific dowry demand or assault was alleged against him. The State opposed bail. The Court, after considering the clean record and the informant’s statement, ordered the release of the petitioner on bail of Rs.10,000 with two sureties, subject to conditions of cooperation, presence in court, and non‑tampering with evidence, and directed verification of any concealed criminal antecedent.
Issues considered
- Whether bail should be granted to the accused in a dowry‑death case where the FIR alleges suicide and the accused has a clean antecedent.
