Patna High Court

Angad YadavversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court held that bail should be granted to the petitioners.

Summary

The petitioners, Angad Yadav and Dinesh Yadav, were arrested in connection with a case under the Arms Act (sections 25(1‑B)(a), 26(2), 27 and 35) after the prosecution alleged that rifles, a shotgun and live cartridges were recovered from their possession. The petitioners contended that no incriminating article was actually seized from them, that they had been falsely implicated, and that they had been in custody since 14 November 2025 with a chargesheet already filed. They applied for regular bail, undertaking to cooperate with the investigation. The State opposed the bail. Considering the seriousness of the allegations, the length of pre‑trial detention (over six months), and the filing of the chargesheet, the Court ordered that both petitioners be released on bail upon furnishing a bail bond of Rs 10,000 with two sureties of the same amount each, to be satisfied before the Judicial Magistrate of Khagaria. The order effectively granted regular bail to the accused.

Issues considered

  • Whether the petitioners are entitled to regular bail under the Arms Act despite the prosecution’s allegations and more than six months of pre‑trial detention.
