Patna High Court

Amarjeet KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court held that bail should be granted as the petitioner has a clean antecedent and the case is based merely on suspicion.

Summary

Amarjeet Kumar was arrested on 8 February 2026 in connection with a case alleging that he impersonated another person, Chanchal Kumar, to appear in the CTET examination. The FIR, dated 7 February 2026, charges him under sections 318(4), 338, 336(3), 340(2) and 3(5) of the B.N.S. The petitioner, represented by Mr. Akash Shankar, contended that he has a clean criminal record and that the accusations are fabricated, relying only on suspicion. The State, through Additional Public Prosecutor Mr. Ajay Mishra, opposed the bail application. The Court examined the facts, noted the absence of any material evidence beyond suspicion, and considered the petitioner’s clean antecedent. Consequently, the Court ordered his release on bail with a bond of Rs. 10,000 and two sureties, subject to conditions of cooperation, non‑tampering with evidence or witnesses, and verification of antecedents. The bail order emphasizes that any breach of conditions may lead to cancellation of the bond.

Issues considered

  • Whether bail should be granted to the petitioner accused of impersonation under the B.N.S. on the basis of suspicion and a clean antecedent
  • Whether the allegations in the FIR constitute sufficient ground to deny bail
