The Court allowed bail to the petitioners subject to bond and conditions.
Summary
The petitioners, Rajeev Kumar Rai and Sanjeev Kumar Singh, were arrested in connection with a case where the informant's son allegedly died after being assaulted with sticks, an iron rod, a pistol and axes. They were charged under multiple sections of the Bihar Negotiable Instruments Act, 2023 and Section 27 of the Arms Act. The petitioners argued that the FIR contained only a generic allegation against all accused and did not specifically allege any overt act by them, seeking bail. The State opposed bail, emphasizing the seriousness of the offence and the petitioners' alleged participation in the murder. The Court examined the nature of the allegations and, considering the petitioners' pending cases and bail status in other matters, granted bail on a bond of Rs.10,000 with two sureties and imposed conditions regarding trial cooperation, evidence tampering, and verification of criminal antecedents.
Issues considered
- Whether bail can be granted to the accused in a case involving alleged murder and multiple serious offences.
- Whether the FIR specifically implicates the petitioners or merely contains a generic allegation against all accused.
