BAIL GRANTED

Holding

The court granted anticipatory bail to the petitioner, subject to a bail bond of Rs.10,000 and two sureties, under the conditions of Section 482 of the B.N.S.S., 2023.

Summary

The petitioner, Vikas Ray, sought anticipatory bail fearing arrest in a case registered under several offences of the Bhartiya Nyaya Sanhita, including assault and causing simple injuries. The FIR alleged that he assaulted the informant and her husband with a Dabiya and an iron rod, causing simple injuries. The State and the informant opposed the bail, arguing the seriousness of the offences. The court considered the nature of the injuries and the likelihood of arrest within eight weeks, and decided to grant anticipatory bail on the condition of a Rs.10,000 bail bond with two sureties and compliance with Section 482 of the B.N.S.S., 2023. The order was pronounced by Justice Prabhat Kumar Singh.

Issues considered

  • What is the appropriateness of granting anticipatory bail under Section 482 of the Bhartiya Nyaya Sanhita, 2023 in the present case?
  • Whether the nature of the alleged assault and injuries justifies denial of anticipatory bail?
