DISMISSED

Holding

The application for regular bail was dismissed.

Summary

Ankaj Kumar was arrested in connection with a murder case (Sections 302, 120(B) and 34 IPC) and an offence under Section 27 of the Arms Act. He applied for regular bail after being in custody since 21 January 2024, having previously been denied bail and only granted provisional bail for his father's medical treatment. The petitioner argued that the trial had not progressed and witnesses had not been examined despite charges being framed. The Court noted the seriousness of the offences and was not persuaded by the delay in trial to grant regular bail. Consequently, the bail application was dismissed and the Superintendent of Police was directed to ensure witness attendance in the trial.

Issues considered

  • Whether regular bail should be granted to the accused in a murder and arms case despite trial delays

                                2. This is the second attempt of the petitioner for grant

of regular bail in connection with Nawkothi P.S. Case No. 102

of 2023 registered for the offence under Sections 302/120(B)/

34 of the Indian Penal Code and Section 27 of the Arms Act.

                                3. This Court had granted provisional bail to the

petitioner for the treatment of his father. Pursuant thereto, the

petitioner duly surrendered before the court concerned. Learned

counsel for the petitioner submits that though the petitioner is in

custody since 21.01.2024, in the trial there has been no progress

                                     4. Considering the allegations, I am not inclined to
