Holding

The court granted regular bail to the petitioners.

Summary

The petitioners, a driver and co‑driver of a truck, were arrested after 7,866.72 litres of illicit foreign liquor were seized from the vehicle. They claimed they had no knowledge of the contraband, were not in possession of it, and had no criminal antecedents. The prosecution alleged a violation of section 30(a) of the Bihar Prohibition and Excise Act. The petitioners argued that the seizure list was not prepared in accordance with Section 105 of the BNSS and that they had been in judicial custody since 9 January 2026 without any evidence of guilt. After hearing both sides, the court found the petitioners’ arguments persuasive and ordered their release on regular bail, requiring a bond of Rs 10,000 each with two sureties, subject to the satisfaction of the Exclusive Excise Special Court, Buxar.

Issues considered

  • Whether the driver and co‑driver are entitled to regular bail under section 30(a) of the Bihar Prohibition and Excise Act.
  • Whether the seizure of the liquor complied with the procedural requirements of Section 105 of the BNSS.
  • Whether the absence of possession and lack of criminal antecedent justify granting bail.

been made in para-3 of this petition that the petitioners have got

no criminal antecedent. There is no independent witness of the

seizure list rather they are police personnel and police has not
