Anil Kumar SinghversusThe State of Bihar

Decided
Disposal
BAIL REJECTED

Holding

Anticipatory bail was denied to the petitioners.

Summary

The petitioners, Anil Kumar Singh and Rahul Kumar Singh, filed an anticipatory bail application fearing arrest in a case (Pipra PS Case No.176 of 2023) involving offences under IPC sections 341, 323, 324, 307, 354, 379 and 506/34. Both are named in the FIR; Rahul is alleged to have given the order for the assault, while Anil is accused of assaulting the informant’s brother and grandmother. The court noted that each petitioner has multiple prior criminal convictions, indicating a pattern of habitual offending. Considering the seriousness of the alleged offences and the petitioners’ criminal antecedents, the bench was not persuaded to grant the privilege of anticipatory bail. Consequently, the application for anticipatory bail was rejected.

Issues considered

  • Whether anticipatory bail should be granted to the petitioners under the circumstances of the FIR.
  • Whether the petitioners’ prior criminal antecedents and the nature of the alleged offences justify denial of anticipatory bail.
